LegitOrScam Affiliate Agreement

1. To become an affiliate of LegitOrScam and participate in our affiliate program, you must agree to the terms and conditions outlined in this Affiliate Agreement.
2. This Agreement establishes the complete terms and conditions between LegitOrScam and you, regarding your application to participate as an affiliate and the establishment of links from your website to LegitOrScam.Site and its subdomains and services.
3. By submitting your application to join or participating in the LegitOrScam affiliate program, you confirm that you have read and agree to be bound by the terms and conditions of this Agreement. You also acknowledge that our Privacy Policy governs your participation in our affiliate program.
4. Please note that the original language of this Agreement is English, and any translations provided are for convenience only. In the event of any conflicts between the English version and any translation, the English version shall prevail.
5. To begin the enrollment process, you must submit a completed Affiliate Registration Form, which can be found at https://legitorscam.site/affiliate-dashboard.
6. You also agree to display on your site only those graphic or textual images (indicating a Link) provided by us or text messages expressly approved in advance and in writing by LegitOrScam.
7. You are not allowed to post any refunds, credits or discounts, or other content concerning LegitOrScam.
8. As our affiliate, you will earn commissions when referred users make purchases on LegitOrScam after following the links from your site. We will handle all aspects of order processing and fulfillment, including LegitOrScam service, cancellation, processing, refunds, and payment processing. We reserve the right to reject orders that do not comply with the terms of this agreement or our terms of service. To ensure that you receive accurate commission payments, you must properly format the links between your site and LegitOrScam’s website.
9. Under the LegitOrScam Affiliate Program, you can earn a commission fee for each qualified purchase made by a referred user, subject to certain criteria. To qualify for a commission fee, each referred user must be a new and unique visitor to LegitOrScam, and must make a qualified purchase with valid payment for LegitOrScam services. The referred user must also be an active, qualified user of LegitOrScam and up-to-date in all payments at the time the commission fees are processed, without having been subject to a refund, credit, cancellation, suspension, or chargeback.
10. To participate in the LegitOrScam Affiliate Program, you must register by completing and submitting the registration form using a valid and unique account and billing information. LegitOrScam reserves the right to suspend payment of commission fees at any time and indefinitely if it suspects fraud, fraudulent traffic, improper activity, or a potential breach of any of the terms in this agreement by the affiliate or a referred user(s).
11. LegitOrScam may also withhold, reverse, deny, or reject any commission fee and/or terminate the affiliate agreement immediately for various reasons, including fraudulent or questionable activity, orders deemed fraudulent, or altering LegitOrScam’s links in any way. Affiliates who use misleading sites or social media accounts, or engage in unethical marketing practices, may also be subject to commission fee deduction or termination.
12. Commission fees will be processed 30 days after the end of the month in which they accrued, provided that the affiliate issues an invoice within 10 days from the end of that calendar month. Commission fees are subject to deduction for canceled purchases.
13. The LegitOrScam Affiliate Program offers commissions for every qualified purchase made by a referred user, as outlined in the Commission Plan available at https://legitorscam.site/affiliate-commission.
14. The commission withdrawal threshold is $50.
15. LegitOrScam reserves the right to change the Commission Plan at any time, and may negotiate special commission rates with certain affiliates or reduce future commission rates for individual affiliates based on poor performance or promoting their own LegitOrScam services.
16. Commission fees will be paid based on the current information in your affiliate profile, and it is your responsibility to promptly notify LegitOrScam of any changes to your address by updating your profile information. Payment will be made within 30 days of the end of the applicable calendar month for commission due for that month.
17. As a LegitOrScam affiliate, it is your responsibility to provide accurate tax and payment information to LegitOrScam to enable the issuance of commission fees. You are also responsible for paying any applicable taxes related to the commissions you receive under this agreement.
18. Furthermore, you represent, warrant, covenant, and agree not to use LegitOrScam services or the LegitOrScam website to engage in or promote any prohibited activity, and agree to comply with all state and federal laws, rules, and regulations applicable to the operation of your business.
19. Referred users who purchase LegitOrScam services through the affiliate network will be considered LegitOrScam users, subject to all of LegitOrScam’s rules, policies, and operating procedures regarding LegitOrScam orders, LegitOrScam service, and LegitOrScam sales.
20. As a LegitOrScam affiliate, you must not create, publish, transmit, or distribute any bulk electronic mail messages, also known as “spam.” Failure to comply with this section, the CAN-SPAM Act of 2003, or LegitOrScam’s Anti-Spam Policy may be deemed a material breach of this agreement, which could foreclose any and all rights you may have to commissions. Additionally, if your account generates excessive clicks in a short period of time, as determined by LegitOrScam in its sole discretion, the affiliate relationship may be terminated.
21. You must not make any specific use of LegitOrScam marks for purposes other than promoting LegitOrScam services and/or the LegitOrScam site without first submitting a sample to LegitOrScam and obtaining express written consent from your LegitOrScam account executive, which shall not be unreasonably withheld. You agree not to use LegitOrScam marks in any manner that is disparaging or portrays LegitOrScam, any hosted member of LegitOrScam, or any LegitOrScam employee or representative in a negative light. LegitOrScam reserves all of its rights in LegitOrScam marks and other proprietary rights, and may revoke your license at any time by giving you written notice. If not revoked, this license will terminate upon expiration or termination of this agreement.
22. The term of this agreement will begin upon LegitOrScam’s acceptance of your application to enroll in the affiliate program and acceptance of your registration form, and will end when terminated by either party. You may only earn commission fees on qualified purchases occurring during the term, and commission fees earned through the date of termination will remain payable only if the orders for the related LegitOrScam services are not canceled and comply with all terms stipulated in this agreement. LegitOrScam may withhold your final payment of commission fees for a reasonable time to ensure that all qualified purchases are valid and payments from referred users are legitimate, as determined by LegitOrScam in its sole discretion.
23. Any affiliate who violates this agreement or LegitOrScam’s terms of service will immediately forfeit any right to accrued commission fees and will be removed from the LegitOrScam affiliate program. LegitOrScam reserves the right to remove an affiliate from the affiliate program and to terminate or suspend this agreement at any time for any reason, in LegitOrScam’s sole discretion.
24. Without limitation, an affiliate’s participation in the program and this agreement will be deemed automatically terminated, and all commissions forfeited, upon the affiliate’s violation of any terms of this agreement, LegitOrScam’s terms of service, or any applicable law or regulation.
25. LegitOrScam may modify any of the terms and conditions contained in this agreement at any time in its sole discretion. Such modifications will take effect when posted on the LegitOrScam site. LegitOrScam reserves the right to notify you by email and further reserves the right to withhold notification of any changes made to this agreement.
26. LegitOrScam makes no express or implied warranties or representations regarding the Affiliate Program, LegitOrScam Site, the link, or any LegitOrScam services sold through the Affiliate Program. This includes, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of course of performance, dealing, or trade usage. Additionally, LegitOrScam makes no representation that the operation of the LegitOrScam Site will be uninterrupted or error-free, and will not be liable for the consequences of any interruptions or errors, including the tracking of information about referred users during the period of interruption. You use the LegitOrScam Site, the program, the link (including any widgets), and LegitOrScam’s services at your sole risk and at your own free will.
27. LegitOrScam’s content is based on user-generated content, and LegitOrScam makes no representations as to any of the information found on the LegitOrScam Site. The Affiliate Program, our services, and all materials on LegitOrScam’s site and the link are provided on an “as is” and “as available” basis, without warranties of any kind. LegitOrScam disclaims any warranties regarding the security, reliability, timeliness, and performance of the LegitOrScam Site and/or services.
28. You acknowledge that LegitOrScam is not liable for the defamatory, offensive, or illegal conduct of third parties, including other users of the program, our service, or the LegitOrScam Site, and that the risk of injury from the foregoing rests entirely with you. LegitOrScam makes no warranty and disclaims all liability regarding the completeness, accuracy, consistency, or security of the LegitOrScam Site and the LegitOrScam services. We are not responsible or liable for harm that results from your enrollment in the Affiliate Program or use of the LegitOrScam Site or any service provided therein.
29. Should the materials or services provided prove defective and/or cause any damage to equipment or any loss or inconvenience to the affiliate or anyone claiming through the affiliate, the affiliate assumes the entire cost and liability for such damage or loss.
30. You and LegitOrScam are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on LegitOrScam’s behalf. You will not make any statement, whether on your site or otherwise, that would reasonably contradict anything in this section.
31. You hereby undertake, represent, and warrant to LegitOrScam as follows:
32. During the term of the agreement, you will not include in your site any content that is, in LegitOrScam’s opinion, unlawful, harmful, threatening, defamatory, obscene, harassing, racially, ethically, or otherwise objectionable or in violation of LegitOrScam’s terms of service or acceptable use policy.
33. You are at least eighteen (18) years of age.
34. You are not engaged in any Prohibited Activity.
35. Each referred user and each qualifying purchase referred or submitted by you to LegitOrScam is valid, genuine, unique, and not fraudulent, and meets each of the criteria for generating a commission fee as provided in this agreement.
36. You shall not use, procure, bid on, or otherwise arrange for a sponsored link which uses or includes any of the LegitOrScam Marks.
37. You undertake, directly and indirectly, not to register, procure, or use any internet domain name that includes any of the LegitOrScam Marks or any variations or names similar to any of the LegitOrScam Marks.
38. By submitting your application, you acknowledge that you have read this agreement and agree to be bound by all its terms and conditions. You understand that LegitOrScam may, at any time, directly or indirectly solicit relationships with entities that operate websites similar to or compete with your website, on terms that may differ from those contained in this agreement.
39. You have independently evaluated the desirability of participating in the LegitOrScam Affiliate Program and are not relying on any representation, guarantee, or statement other than as set forth in this agreement.
